Mirabello Carrara S.p.A. provides you – as data subject (hereinafter "Data Subject" or "User") with this policy regarding the processing of personal data of users who consult the website www.mirabellocarrara.it or shop.mirabellocarrara.it/ (the "Website") pursuant to Article 13 of EU Regulation No. 679/2016 on the protection of personal data (the "Regulation").
This policy is provided only for the Website and not for other websites that may be consulted by the User through links.

PURPOSE AND LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA, NATURE AND CONSEQUENCES OF FAILURE TO PROVIDE THE DATA
The data related to the User that the Controller collects and processes through the Data Subject's access to the Website are those data that the User has freely and spontaneously entered, if applicable, for the creation of a personal profile for the purposes indicated below.
Such data include: name, surname, date of birth, residential address, shipping address, telephone number, and personal email address ("Personal Data").
The Controller also informs you that the IT systems and software procedures used to operate the Website acquire, during their normal operation, some data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of the computers used by users connecting to the site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the operating system and the User's IT environment. These data are used solely to obtain anonymous statistical information on the use of the Website and to check its correct functioning.
The Controller also informs you that the credit card data (card number, cardholder, expiry date, security codes), which will be requested from the User to make online purchases of products for sale on the Website, will be acquired by the payment service provider, who will act as an independent data controller. Such data will be acquired in encrypted format and in accordance with the security requirements of industry certifications. The Controller will only keep track of the last four digits of the credit card number and its expiry date, as well as the log files and IP addresses used at the time of finalizing the purchase, in order to prevent and ascertain any fraud in online transactions.
Your Personal Data will be processed, as the case may be, for the following purposes:
- website registration;
- conclusion, execution, and operational management of the contract for the sale of goods through the Website, as well as for purposes strictly connected, related, derived, and instrumental to the sale (e.g., product selection, order placement and acceptance, delivery, and any exercise of the right of withdrawal and subsequent collection of goods, as well as any other obligations provided for in the terms of sale);
- tax and administrative-accounting, as a direct consequence of purpose (ii);
- sending email communications aimed at promoting the sale of products similar to those already purchased by the User, without prejudice to the User's right to object at any time in the manner specified in paragraph 8 of this policy;
- sending - by postal service or by SMS, email, telemarketing and similar means - of other commercial/marketing/newsletter communications relating to products marketed by the Controller and, specifically, offers, news, discount coupons, promotions and special events;
- analysis of the User's consumption preferences and habits and processing of the User's personal preferences and interests by means of automated tools and the transmission of personalized offers through the Website;
- responding to any communications sent to the Controller, including through the Website, or by email or telephone, to report problems and/or to submit requests (including for assistance) or observations regarding the products and/or the contractual relationship.
At the time of collection of Personal Data for the aforementioned purposes, specific information pursuant to Article 13 of the Regulation will be provided, if applicable, in the relevant sections of the Website, and the related consents to processing will be requested where required.
The provision (and related processing) of Personal Data:
- is necessary for the purposes referred to in paragraph 2 (i), (ii) and (iii), in order to allow the Company to follow up on the User's request for registration to the Website and to fulfill its contractual and/or legal obligations. Therefore, failure to provide it would make it impossible for you to browse the reserved areas of the Website, proceed with the purchase of desired products, have the delivery carried out, the eventual return of the products, as well as any other obligation provided for in the terms of sale;
- is optional for the purposes referred to in paragraph 2 (iv), it being understood that the related processing does not require your prior consent, given the legitimate interest of the Controller in sending email communications aimed at promoting the sale of products similar to those you have already purchased on the Website. However, if you refuse the use of your Personal Data – by exercising your right of so-called opt-out, in the manner provided for in paragraph 8 below of this policy – for the sending of such future communications, this will not have any consequence on your ability to proceed with the purchase of desired products, but it will prevent you from receiving informative and/or commercial communications relating to the Controller's products similar to those you have already purchased;
- is optional for the purposes referred to in paragraphs 2 (v) and (vi) and the related processing is permitted only with prior consent as per paragraph 7 below of this policy. Failure to provide (and related processing of) Personal Data for these purposes will not have any consequence on your ability to proceed with the purchase of desired products, but it will prevent you from receiving commercial/marketing communications, possibly personalized, related to the Controller and the Controller's products;
- is necessary for the purposes referred to in paragraph 2 (vii), in order to allow the Company to follow up on the communications and/or requests submitted by you. Therefore, failure to provide (and related processing of) Personal Data for this purpose would make it impossible for the Controller to provide answers to the communications and/or requests you have sent.
It should therefore be noted that all processing of Personal Data is based on a specific legal basis in accordance with current law. In particular, depending on the purposes indicated above, the processing of Personal Data:
- is necessary for the performance of a contract/agreement with the User or to follow up on activities requested by the User;
- is based on the legitimate interest of the Controller;
- is based on the User's prior express consent.

PROCESSING METHODS AND STORAGE PERIOD
The processing of Personal Data is carried out by means of the operations indicated in Art. 4 no. 2 of the Regulation, namely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, erasure, and destruction of data.
Personal Data will be processed, with the support of electronic, IT and/or paper means, strictly for the purposes set out above and in such a way as to guarantee their security and confidentiality and in order to prevent their loss, unlawful or incorrect use and unauthorized access.
Personal Data will be processed:
- with reference to paragraph 2 (i), until you delete your Account profile from the Website;
- with reference to paragraphs 2 (ii) and (iii), for the time necessary to execute the contractual relationship and for the fulfillment of legal and administrative-accounting obligations incumbent on the Controller for a maximum period of 10 years from the termination of the relationship;
- with reference to paragraph 2 (iv), until you exercise your right to opt-out in the manner provided for in Article 8 below;
- with reference to paragraph 2 (v), for a maximum period of 24 months;
- with reference to paragraph 2 (vi), for a maximum period of 12 months;
- with reference to paragraph 2 (vii), for the time strictly necessary to achieve the purposes for which they were collected.
In any case, the limitation periods set for the rights and obligations underlying the processing carried out will be respected.
It should be noted that, in any case, your Personal Data will be processed by the Controller's staff duly appointed and instructed by the Controller himself.

RECIPIENTS OF PERSONAL DATA
Personal Data may be communicated, in close relation and compatible with the purposes set out above, to the following categories of subjects:
- companies belonging to the Group to which the Controller belongs for the purposes referred to in paragraph 2 (ii) and, in particular, to ensure adequate support to the User with respect to the products;
- third parties for any activities carried out in outsourcing on behalf of the Controller, including, in particular
- transport/shipping services;
- mailing services, also aimed at communicating the progress of the order to the User or sending commercial/marketing communications;
- data analysis services;
- services for the application management of the Website;
- banks and credit institutions;
- supervisory authorities.
The subjects belonging to the aforementioned categories operate in total autonomy, as independent data controllers, or as processors who carry out activities in the interest of the Controller. The list of processors can be requested at the following email address privacy@mirabellocarrara.it

TRANSFER OF PERSONAL DATA TO A THIRD COUNTRY OR AN INTERNATIONAL ORGANIZATION
The Controller does not intend to transfer Personal Data to countries outside the European Union.
It is understood, in any case, that the Controller – should it become necessary (essentially in consideration of the location of the servers of third parties called upon to perform, on behalf of the Controller, outsourced services as referred to in paragraph 4 of this policy) – will have the right to transfer your Personal Data also outside the EU. In this case, the Controller hereby assures that the transfer will take place in accordance with the applicable legal provisions, after adopting the standard contractual clauses as issued by the European Commission.

At any time, you will also have the right to withdraw consent (or exercise opt-out), where it has been given in accordance with this policy. The withdrawal of consent to processing does not affect the lawfulness of processing carried out based on the consent previously given.

Finally, it should be noted that the Data Subject has the right to lodge a complaint with the Garante per la Protezione dei dati personali (Italian Data Protection Authority) if they believe that the processing concerning them violates the provisions of EU Regulation No. 679/2016.
